Signal Hill Child Custody

Signal Hill Child Custody Lawyer

Signal Hill child custody has two parts under California law: physical custody and legal custody. Joint custody allows the parents to have joint physical custody and joint legal custody. However, the court can award joint legal custody, and not award joint physical custody. Under physical custody, one parent may be granted sole physical custody where the child would reside with and be supervised by one parent. Under joint physical custody orders, the parents share physical custody, and the law ensures that the child have frequent and continuing contact with both parents.

Sole legal custody allows one parent the right and responsibility to make decisions about the health, education, and welfare of the child. Joint legal custody allows both parents to share these rights and responsibilities. California law does not establish a preference for sole or joint custody in contested proceedings.

There are considerations the law establishes in making Signal Hill child custody awards. Public policy of California is to ensure the minor children frequent and continuing contact with both parents. Also, custody orders must be made according to the child's best interest. Domestic violence and a history of abuse will be considered by the court in determining the child's best interest. Move-away/relocation cases arise when one parent seeks to move to another jurisdiction. The court must evaluate the child's need for stability and continuity. Move-away/relocation cases are generally hotly contested.

The court may award an amount depending on he party's need and he payer's ability to pay. Judges typically use the support software when ordering temporary Signal Hill spousal support.

Long-term Signal Hill spousal support may be ordered by the court in any amount, and for any period of time that the court deems just and reasonable. In making a determination for support, the court must base its decision on the marital standard of living. The court must also consider the extent to which each party's earning capacity will maintain the standard of living established during the marriage. The complete list of factors the court must consider are found in California Family Code section 4320.

Limited Scope Representation

California attorneys are allowed to provide Signal Hill limited scope representation to clients involved in family law and civil cases since it was approved by the Judicial Council. Many parties to family law and civil litigation actions would like the help of an attorney for parts of their cases, even if they cannot afford full representation. Attorneys may appear at court hearings even if the attorney did not prepare the legal paperwork. In contrast, attorneys can prepare legal paperwork, but do not have to appear in court if the cause of action actually gets to the point of having court dates. Most people find that having an advocate at the court hearing helps alleviate additional stress that is naturally created with litigation.

About Signal Hill, CA

The history of Signal Hill is colorful and rich. The community is commonly known as an oil town and is probably most famous as a result of the discovery of oil in 1921. However, this diverse community has a bright future with an oil history.

The Puva Indians used a hilltop in order to signal other native Indian tribes on Santa Catalina Island, which was some 26 miles offshore. The Spanish settlers named the hill Loma Sental, which translates from Spanish into Signal Hill, as a result of its use as a signaling point.

In 1784, a man named Manuel Nieto became the first landowner of record. He received a land grant from the Spanish King Carlos III. Manuel Nieto subdivided his land sometime later into six cattle and horse ranchos, two of which, named Rancho Los Cerritos and Rancho Los Alamitos, were located in what is currently known as Signal Hill.

During the 1800's, New Englanders bought these two ranchos, which were primarily used for agriculture and grazing. The Bixby family bought the ranchos and used them to raise sheep, after financial hardships, drought, and a harsh winter in 1862 resulted in the forced sale of them by the New Englanders.

As the value of the panoramic view became increasingly more evident, there were stately mansions all over the hilltop by the turn of the 20th century. However, the value of this panoramic view was surpassed by the prospect of striking oil in 1917 and the Union Oil Company drill the first oil well in the region. This oil well was eventually abandoned as it failed to produce any oil. In 1921, the Royal Dutch Shell Oil Company finally struck oil following a suspension of any further exploration for oil. The Alamitos Well # 1 produced the first gusher, which became a turning point in the history of Signal hill and put the community on the map. By 1984, this well had produced over one billion barrels of oil, which ultimately made it one of the richest oil fields in the world. In 1994 alone the oil field produced 1.6 million barrels of oil and the oil field is still active.

Signal Hill had been located on the County of Los Angeles and completely surrounded the community of Long Beach. The founding fathers of Signal Hill voted to incorporate the community as a city in order to avoid paying a per barrel tax on oil that Long beach wanted to impose. Signal proved to be a very progressive city right from the start. A woman named Mrs. Jessie Nelson became the first mayor of the new city. Up until the 1970's when declining oil prices reduced oil production, the production of oil was the economic mainstay of Signal Hill. The Signal Hill Redevelopment Agency was established in 1974 and the community focused on diversity and economic development away from oil. These days, Signal Hill is an economically diverse, financially sound, and well balanced community of more than 11,400 people.
